Sovereign Hardware & Construction Terms and Conditions
Welcome to Sovereign Vent Blocks! These Terms and Conditions govern the sale of our decorative vent blocks and the use of our products and services. By purchasing from Sovereign, you agree to the following terms:
1. Definitions
- "Sovereign" refers to the vent block business providing the products or services.
- "Customer" refers to the individual or entity purchasing products from Sovereign.
- "Products" refers to the vent blocks offered by Sovereign.
2. Acceptance of Orders
- All orders placed with Sovereign are subject to acceptance and availability of the requested products.
- Orders are considered confirmed only upon receipt of payment in full.
3. Product Quality and Warranty
- Sovereign guarantees that all products are manufactured to high-quality standards and delivered free from defects.
- Natural variations in texture, color, or finish may occur due to the nature of the materials used. Such variations are not considered defects.
- Sovereign does not provide warranties beyond the stated guarantee, and no additional assurances are implied.
4. Customer Responsibilities
- Customers are responsible for providing accurate delivery details and ensuring someone is available to receive and inspect the products at the scheduled delivery time.
- Customers are responsible for the proper handling, storage, and installation of the products after delivery.
- Sovereign is not liable for damage resulting from mishandling, improper storage, exposure to adverse environmental conditions, or unauthorized modifications to the products.
5. Delivery and Risk of Loss
- Ownership and risk of loss transfer to the customer upon successful delivery of the products in good condition.
- Customers must inspect the products upon delivery and report any damages or discrepancies within 24 hours. Claims made after this period will not be honored.
- Sovereign is not responsible for delays or non-delivery caused by circumstances beyond its control, including weather, transportation issues, or force majeure events.
6. Returns and Refunds
- Returns and refunds are subject to Sovereign’s Returns Policy (available at [insert link]).
- No returns will be accepted for products damaged after delivery or for custom-made items unless they are proven to be defective upon delivery.
7. Limitation of Liability
- Sovereign’s liability for any claim, whether arising from breach of contract, negligence, or otherwise, is limited to the replacement or refund of the defective product.
- Sovereign is not liable for:
- Loss of revenue, profits, or business opportunities.
- Indirect, incidental, or consequential damages, even if advised of the possibility of such damages.
- Personal injury, property damage, or other losses arising from the misuse, mishandling, or improper installation of the products.
8. Indemnification
- The customer agrees to indemnify and hold harmless Sovereign, its officers, employees, and agents from and against any claims, damages, losses, or expenses (including attorney’s fees) arising out of the customer's use or misuse of the products.
9. Governing Law
- These Terms and Conditions are governed by the laws of the Republic of Trinidad & Tobago. Any disputes arising under these terms will be subject to the exclusive jurisdiction of the courts in Trinidad & Tobago.
10. Amendments
- Sovereign reserves the right to amend these Terms and Conditions at any time. Customers will be notified of any changes, and continued use of Sovereign's products constitutes acceptance of the revised terms.
11. Entire Agreement
- These Terms and Conditions, along with the Returns Policy and any other written agreement, constitute the entire agreement between Sovereign and the customer.
